The capital Khartoum was founded in 1821 as part of Egypt, and with its population of ±6.3 million, its metropolitan area is the largest in Sudan. It is located at the confluence of the White Nile, flowing north from Lake Victoria, and the Blue Nile, flowing west from Lake Tana in Ethiopia.

Sudan’s main exports include cotton and sesame.

Sudan is one of the richest African countries in terms of archaeological sites. The ruins of the ancient kingdom of Kush at Gebel Barkal and associated sites in the Nile valley were collectively designated a UNESCO World Heritage site in 2003.

Some of the world’s most diverse and spectacular marine tropical habitats exist in Sudan, especially in the two main Marine National Parks – Sanganeb Atoll and Dungonab Bay-Mukkawar National Park.

What is the main language spoken in Sudan:

Sudan is a multilingual country dominated by Sudanese Arabic.

As per the 2005 constitution of the Republic of Sudan, the official languages of Sudan are Literary Arabic and English.

Over 100 languages and dialects are spoken and recognized throughout Sudan, including Beja, Sudanese Arabic, Nubian, Ta Bedawie and Fur.

WHAT INCOME IS TAXABLE IN Sudan:

Any income earned in the form of cash, wages, salary, overtime, leave pay or payment in lieu of leave, commissions, gratuity, bonus, or any amount that has benefited the employee.  All income will be taxed in accordance with the law and the final payroll issued monthly.

What income is exempt from taxes in Sudan:

  • Residents are subject to tax on employment income, all business profits, real estate leases income and personal income from worldwide sources.
  • Non-residents are taxed only on Sudan-source income.
  • Employment income generally is taxable unless otherwise exempt.
  • Business profits earned by an individual from a trade or profession, leasing income and other investment income also are taxable.

Standard working hours: Number Overtime to be paid?

Working Hours in Sudan
  • Official hours of work are 48 hours per week or 8 hours per day broken by a paid period of rest of not less than half an hour per day for eating or resting.
Overtime
  • Overtime shall not exceed 4 hours per day or 12 hours per week.
  • The worker shall receive his payment for overtime work as follows:
    • during the normal working days, he shall be entitled to receive the equivalent of his wage of one hour and a half for each hour of overtime;
    • during official holidays, he shall be entitled to receive the equivalent of his wage of two hours for each hour of overtime work.

There is no statutory requirement to pay a 13th or 14th month salary / bonus in Sudan – and it is not evidenced as customary in general to give bonuses.

What Gratuity / Severance payments do you need to provide for Sudan:

Before employing your employees in Sudan, it is always advisable to understand your risk from an employment perspective.  Unfortunately, nothing is guaranteed and in the event that you need to terminate for a valid reason, we always suggest that you know what you are in for in the unlikely event you need to terminate.

Below are the types are terminations in Sudan:

Notice period:

  • Calculated based on length of service and employment type
  • Can be from ± 1 month
  • Prior written notice required

Severance [economic reasons]:

  • Employees who have spent a minimum of 3 years continuous employment at an employer are generally entitled to full severance pay as follows:
    • 3 years to 10 years = severance pay equivalent to one basic monthly salary for each year of service
    • 10 years to 15 years = severance pay equivalent to one and a half of basic monthly salary for each year of service
    • 15 years onwards = severance pay equivalent to one and three quarter of basic monthly salary for each additional year of service provided that the severance pay does not exceed the basic salary for 36 months.

CAN YOU GIVE FRINGE BENEFITS IN Sudan:

Yes you can but keep in mind that Fringe Benefits will be subject to employee PAYE tax.  Only benefits that cannot be converted to cash will not be subject to tax.  If the employer covers some of the employees expenses i.e. mobile phone then it must be subject to PAYE tax and either the employer will cover this portion for the employee or the employee will bear the PAYE tax.

Mandatory Probation period of Sudan:

Sudanese law limits probations to three months in addition to any training period required.

Is 13th month pay (Bonus) mandatory?

Not mandatory, applicable as per contract.
